These Terms & Conditions ("Terms") govern your use of Chi-Cup® - Your Cup Your Way ("we", "us", or "our") and our website https://chi-cup.com (the "Site"). By accessing or purchasing from the Site, you agree to these Terms. Please read them carefully before placing an order.

1. General Use of the Site

By using the Site, you confirm that:

  • You are at least 18 years old or have parental/guardian consent if under 18.
  • You will comply with all applicable laws and regulations while using the Site.
  • All information you provide during checkout is accurate, complete, and current.

2. Products and Personalisation

We specialize in offering Chi Cup drink cups that can be personalised with designs, including customer-uploaded images or text. By purchasing a personalised product from us, you agree to the following terms:

2.1 Responsibility for Uploaded Designs

  • Accuracy: You are responsible for checking the accuracy, resolution, and overall quality of your design before submitting your order. Designs that are blurry, distorted, or of low resolution may result in lower print quality, especially due to the conical shape of the cup.
  • Intellectual Property Compliance: By uploading a design, you confirm that it does not infringe upon any copyright, trademark, or other intellectual property rights. You are solely responsible for ensuring that your design is compliant with intellectual property laws.
  • Disclaimer: We are not liable for any copyright or trademark violations resulting from customer-uploaded designs. By proceeding with the upload, you confirm that your design does not include unauthorized material.

2.2 Inappropriate Designs

We reserve the right to reject any design that contains inappropriate or offensive content. In such cases, we will notify you and offer a full refund. Inappropriate content includes, but is not limited to, designs that:

  • Are discriminatory, defamatory, or offensive.
  • Promote hate speech, violence, or illegal activities.

2.3 Brand Protection

Our Chi Cup logo is injection-molded into the base of every cup. We reserve the right to reject designs that may harm the Chi Cup brand. Designs that are deemed damaging to our brand will not be printed, and a full refund will be issued.

3. Orders and Payment

3.1 Order Process

Once your order has been placed, you will receive an email confirmation. All orders are subject to availability, and we reserve the right to refuse any order for any reason.

3.2 Pricing

All prices on the Site are in GBP unless otherwise stated. Prices do not include delivery charges, which will be calculated at checkout.

3.3 Payment Methods

We accept payments via Stripe and other payment methods indicated at checkout. You must provide accurate payment details when placing an order. Failure to do so may result in the cancellation of your order.

4. Shipping and Delivery

We aim to process and dispatch orders within the timeframe indicated during checkout. Delivery times may vary depending on your location. We are not responsible for delays caused by shipping carriers or during busy periods.

4.1 Busy Periods and Holidays

Please note that orders placed on Fridays, weekends, bank holidays, or during peak periods such as Christmas may experience delays. While we strive to fulfil your order as quickly as possible, delivery times may be extended during these periods.

4.2 International Shipping

We offer international shipping, and shipping rates will be calculated at checkout based on the destination. Please be aware that customs fees and duties may apply to international orders, and you are responsible for these additional costs.

5. Returns and Refunds

5.1 Personalised Products

Personalised products are non-refundable, Due to the custom nature of these products, we cannot offer refunds or returns. We reserve the right to inspect any claims of damage to assess whether they occurred during production or shipping. If it is determined that the damage was caused intentionally or through misuse after delivery, a refund will not be issued.

5.2 Faulty or Damaged Items

If your product is faulty or damaged upon receipt, you must notify us within 7 working days at store@chi-cup.com. We may request photographic evidence of the damage before offering a replacement or refund.

5.3 Incorrect Use of Chi Cup

The Chi Cup and its components must be cared for according to the provided instructions:

  • Dishwasher Use: The lid can be placed in the dishwasher, but the cup itself should be hand-washed gently to preserve the design.
  • Wear and Tear: Over time, the print may degrade due to normal wear and tear. Customers should be aware that the design is not intended to last indefinitely, and we cannot guarantee the print's longevity under excessive use or improper care.

We do not accept refunds or returns if the Chi Cup is damaged due to:

  • Washing in a dishwasher (cup body).
  • Improper handling of components (e.g., water damage).
  • Cleaning the print surface with abrasive materials.

5.4 Return Costs

We do not refund delivery costs or cover the cost of returning the item unless the product is defective or we made an error.

6. Intellectual Property

All content, logos, and images on the Site are owned by Chi Cup® - Your Cup Your Way and are protected by copyright and trademark laws. You are not permitted to use our content for commercial purposes without our express permission.

7. Limitation of Liability

To the maximum extent permitted by law, we shall not be held liable for any indirect, incidental, or consequential damages arising from the use of our products or Site. This includes any loss of data, profits, or business opportunities as a result of using our Services.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United Kingdom. By using our Services, you agree that any legal disputes will be resolved exclusively by the courts of the United Kingdom.

9. Changes to These Terms

We may update these Terms from time to time. Any changes will be posted on the Site, and continued use of the Services indicates your acceptance of the updated Terms.
